All work is carried out by Web Hot Designs on the understanding that the client has agreed to the following terms and conditions.
These Terms and Conditions are subject to change.
Watermarks will not be present in final approved artwork.
Draft images may NOT be used for ANY other purpose than viewing. They may NOT be copied, edited or distributed to ANY other person or company, other than those directly in negotiation with Web Hot Designs WITHOUT prior permission from Web Hot Designs. To do so will be a BREACH of COPYRIGHT.
Artwork supplied by Web Hot Designs MAY NOT be used for any other purpose than the original application.
ie artwork for press adverts, packaging, brochures, etc, may not be used for any other project, in part or in full, at any other time.
Charges for artwork, or artwork production, are for just that. Artwork will normally include commercial quality, press ready pdf or eps files. The working files used to create that artwork are not provided to clients at any time, unless prior arrangements have been made.
Full copyright ownership of final logo designs and creative images or content passes to the client when all accounts have been settled in full.
Copyrights and Trademarks supplied to Web Hot Designs
By supplying text, images and other data for inclusion in a clients website or other medium, the client declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the client, or rightful copyright or trademark owner.
Drafts or proofs of press ads, brochures, Business Cards etc are sent for approval, for both design and content, including the possibility of typographical errors. It is the clients responsibility to check that there are no errors, and if so, corrections must be advised in writing.
If any of our work is published online without our consent, legal matters will commence against said offender.
Prices quoted for website design and build refer to regular, basic information only websites. They will normally include custom graphics and navigation. However, if you require a website with specific design elements that require more time to implement, over and above a regular website, extra charges will apply. Prices quoted do not include Flash animation Headers, Banner Ads or Splash pages, or content creation on behalf of the client. These will be additional extras if required and must be disclosed prior to commencement of your project.
Graphics, scripts and code designed, modified or provided by Web Hot Designs, for any website, can not be used by any future designer/developers if that website is no longer maintained by Web Hot Designs, unless a prior arrangement has been made.
The client agrees to supply all text and pictures required for the inclusion of any items to be designed.
It is expected that all text supplied has been checked for typographical and grammatical errors, and has been approved by all parties that will have a final say in the sign-off of any items produced and sent to the web designer in a basic word document free of formatting. This document must also include clear instructions on links and images which are required on that particular page.
Additional expenses may be incurred for any necessary action, including, but not limited to, photo searches, media conversion, digital image processing and editing, data entry services or content research and creation.
The client agrees that changes and alterations may be made to text and images (with their approval) to improve the design of any items produced (no additional charges for these improvements, this is included with normal design charges).
All images must be Royalty Free (RF) images purchased from a stock library. We will not accept any images which have not been purchased from a stock library website. Web Hot Designs uses and recommends Adobe Stock and iStock for all our high quality website images. Web Hot Designs or it’s Owners are not liable for any damages in regards to breach of copyright laws.
Client also agrees to have all content, images, logos and links etc. to Web Hot Designs prior to any commencement of work. Once content is received Phase 1 of your website design will commence. This is to ensure commitment to meet agreed timeline. If content is not fully received, your project will be taken out of the schedule until said information is received with a new timeline date advised. Due to our busy schedule, we will do our best to accommodate you with regards to this, but cannot guarantee an early resume date.
A refund of client deposit is not available once work has commenced for Phase 1 of the agreement with the client failing to provide content as requested.
Web Hosting is no longer offered as part of our services. We can arrange hosting with our preferred providers and this will be charged back to the client.
Any costs incurred to retrieve outstanding debts will be payable by the client, along with any outstanding amounts owing. Web Hot Designs will not be held responsible for any inconvenience or damage incurred by removing or disabling any online material or services. Any future dealings with such clients will be by payment in advance, without exception.
Web Hot Designs reserves the right to reject a project or client.
- a) establish a fair policy for giving Refunds and for exchanges or return of goods for Purchases;
- b) only give a Refund by means of a Transaction processed to the same Account on which the original Purchase was made, or an exchange of goods, and not in cash or by cheque. The Merchant must disclose the Merchant’s Refund policy to the Customer prior to the Purchase;
- c) where the Merchant is authorised to process Purchases via the Internet, display the Merchant’s Refund policy on its’ website;
- d) at all times act in accordance with the Merchant Operating Guide in processing Refunds; e) comply with the Australian Consumer Law.
If a Purchase is rescinded, terminated, refunded, varied or set aside for any reason whatsoever, or if a Customer is validly dissatisfied with the goods or services you have provided and you have not rectified the dispute with the Customer within 30 days of the dispute arising, then the Purchase is also rescinded, terminated, varied or set aside and we are entitled to a Refund from you of all amounts we have paid to you for that Purchase
If the goods are not delivered within 14 days after authorisation of the Transaction under which the Merchant sells the goods, the Merchant must contact the Accountholder about the delay. The Merchant must request the Accountholder’s permission for the sale of the goods is to proceed, or if these conditions are not met the Transaction becomes invalid.
